That’s simply a real estate purchase contract executed with the intention of assigning the equitable rights in it to another investor.

The equitable rights is a trade-able entity that real estate investors have built profitable businesses on for ages.

Due to social media, the business is getting more popular and attracting abuse and regulations.

“I did some D4D and found another property.

And I did some research and learned that the owners (husband and wife) are deceased.

I was able to find the wife’s obituary (she passed after the husband) and was able to learn of her surviving children.

Now I have yellow letters locked and loaded ready to send to them.

But I had a concern in that I couldn’t find anything in the probate records.

No information came up about the original owners let alone information on the property and its value.

I was curious to know if this would be an issue should I get a response since there is no record of an heir or personal representative for the property.”

What is driving for dollars?

It is a data collecting strategy in the wholesale real estate investing world that I think you should avoid.

Many people misconstrue it for marketing strategy.

The problem with that notion is that you cannot refer to a strategy as marketing unless an actual outreach to a potential lead happens.

The reason why I do not recommend it is the battle that most entrepreneurs struggle with between the importance of quantity versus quality.

There was no EMD placed on the contract.

So would I be in default under the contract if it reads ...If Buyer defaults under this contract, any and all monies deposited by Buyer(s) shall be retained by Seller as full liquidated damages"?..

The Owner is so difficult to work with, and inflexible.

Closing for the property is next week but I have no buyer.

The initial buyer changed his mind, so now the seller has threatened to sue me if I don't bring a buyer to the table.

Can he do this?

I used a purchase agreement which under the inspection contingency it reads that, the buyer may cancel in writing with a written notice "prior" to the expiration of inspection period.

However, the inspection period lapsed. Any suggestions are appreciated.”
